3. How we collect personal information
We collect personal information directly from you when you place an order, create an account, sign up for emails or SMS, contact customer service, or request a shipping quote. We collect information automatically through cookies, pixels, server logs, and analytics tools when you visit the site. We also receive information from third-party service providers — payment processors, advertising platforms, and analytics tools — about your interactions with us through their services. The full list of those providers is in Section 5.
4. Why we collect and use personal information
We use personal information for the following purposes:
- Process orders, accept payment, manage financing, ship products, and fulfill warranty and return obligations
- Communicate with you about orders, account, customer service, and warranty matters
- Send marketing emails and SMS where you have opted in, and tailor those communications based on your interests
- Operate, secure, and improve the site, including detecting fraud and abuse
- Measure the effectiveness of our advertising and marketing
- Comply with applicable law, including tax, customs, and consumer protection requirements
- Establish, exercise, or defend legal claims
For Canadian residents, we collect and use personal information for purposes a reasonable person would consider appropriate in the circumstances, in line with the purpose principle of PIPEDA. For Australian residents, we collect personal information for the primary purpose of operating our business, processing your order, and providing customer service, consistent with Australian Privacy Principles 3 and 6.
5. Service providers we share information with
We share personal information with the third-party service providers listed below, who process it on our behalf or as independent controllers for their own purposes. We do not sell personal information for monetary value. Where a provider acts as an independent controller, their privacy policy governs that processing — links are provided.
Active service providers:
Shopify and Shopify Payments (Shopify Inc., Canada) provides our storefront platform, hosts our site, processes credit and debit card transactions through Shopify Payments (with Stripe as sub-processor), and operates Shopify Inbox for live-chat conversations. Shopify receives the personal information you submit on the site, including order, payment card, billing address, and chat transcripts. Shopify Payments acts as an independent controller for fraud prevention, KYC, AML, and regulatory obligations. We do not store full payment card numbers on our systems. Shopify's privacy notice is at shopify.com/legal/privacy.
Klaviyo (Klaviyo, Inc., USA) sends our marketing emails and SMS, manages subscriber lists, and segments audiences based on browsing and purchase behavior. Klaviyo receives your name, email, phone, order history, and on-site behavioral events when you sign up or make a purchase. Klaviyo acts as a processor under our instructions. Their privacy notice is at klaviyo.com/legal/privacy.
Cloudflare (Cloudflare, Inc., USA) routes storefront traffic for security and performance. Cloudflare receives your IP address, browser headers, and request metadata, and provides aggregated analytics we use to monitor site performance. Cloudflare acts as a processor and operates under cloudflare.com/privacypolicy.
Service providers we plan to enable
The following providers are not currently active. We are listing them in advance as a forward disclosure so you know what to expect. We will update the date below the day any of them goes live; if you are reading this notice and the provider is not listed as active above, we are not currently sharing data with them.
AfterSell (Rokt, USA) shows additional offers on our order-confirmation page once enabled. It will receive your order ID, line items, and the email associated with the order to personalize offers.
Meta Pixel (Meta Platforms, Inc., USA) loads on our pages once enabled to measure conversions from Facebook and Instagram ads, build audiences for retargeting, and personalize ads. The Pixel receives event data including page views, add-to-cart, and purchase events with hashed identifiers. Meta acts as an independent controller for advertising. You can opt out of personalized ads at facebook.com/ads/preferences.
Google Tag Manager and Google Analytics 4 (Google LLC, USA) manage marketing tags and measure site performance once enabled. GA4 receives pseudonymous identifiers, page-view events, and conversion events. Google acts as an independent controller for GA4 data per its terms. You can opt out of GA4 tracking using the Google Analytics opt-out browser add-on.
Wetracked.io (USA) provides server-side tracking once enabled, forwarding conversion events to advertising platforms with first-party context. It will receive the same conversion events sent client-side plus first-party identifiers including hashed email and IP for ad-platform deduplication.
6. Cookies and similar technologies
We use cookies, local storage, pixels, and similar technologies to operate the cart and checkout, remember your preferences, measure site performance, and (where you have not opted out) tailor advertising. You can control cookies through your browser settings or, where applicable, through the consent banner shown on first visit. Our full Cookie Policy describes the categories of cookies in use, their purposes, and how to manage them.
7. International data transfers
We are a US company. Many of our service providers (Klaviyo, Cloudflare, Google, Meta, Wetracked) are also based in the United States. Shopify and Shopify Payments are headquartered in Canada with US sub-processing. By using the site or placing an order, you understand that personal information about you will be transferred to and stored in the United States and Canada and processed under those countries' applicable laws.
Canadian residents: Personal information you provide may be processed in or transferred to the United States, where it may be subject to lawful access by US authorities. We rely on contractual safeguards with our service providers consistent with PIPEDA's accountability principle.
Australian residents: Where we transfer personal information overseas (typically to the United States and Canada), we take reasonable steps to ensure the recipient handles it consistently with Australian Privacy Principle 8.
8. Retention
We retain personal information for as long as we have an active relationship with you and for as long as needed to fulfill the purposes described in this policy, including warranty support (up to the longest applicable warranty period plus a reasonable claim window), tax and accounting record-keeping (typically 7 years), and dispute or fraud resolution. Marketing email and SMS data is retained until you unsubscribe. Customer service correspondence is retained for up to 3 years.
9. Security
We use a combination of technical and organizational safeguards to protect personal information, including TLS encryption in transit, the security infrastructure provided by Shopify and Cloudflare, restricted internal access on a need-to-know basis, and contractual data-protection terms with our service providers. No system is perfectly secure, and we cannot guarantee absolute security; if you believe your account or order information has been compromised, contact us immediately at support@bettrsauna.co.
10. Your rights
You have rights regarding your personal information. The specifics depend on where you live. To exercise any of the rights below, email support@bettrsauna.co with your full name, the email address used for any account or order with us, and a description of your request. We may need to verify your identity before responding (typically by confirming order details). We respond within 30 days; complex requests may take up to 45 days, and we will tell you if we need the additional time.
United States residents
If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, or another US state with comprehensive consumer privacy law, you have the right to: request access to the personal information we hold about you; request that we correct inaccurate personal information; request deletion of personal information we hold about you, subject to legal exceptions; request a portable copy of personal information you provided to us; opt out of targeted advertising and the sale or sharing of personal information for cross-context behavioral advertising; and not be discriminated against for exercising these rights.
California residents (CCPA / CPRA): You have an additional right to request that we limit use of your sensitive personal information. We do not currently use sensitive personal information for any purpose beyond what is reasonably necessary to provide our products and services. To exercise opt-out rights without verification, see Section 12 below.
We do not knowingly process sensitive personal information for inferences about race, ethnic origin, religion, mental or physical health, sex life or sexual orientation, citizenship or immigration status, or biometric information.
Canadian residents
Under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, you have the right to access the personal information we hold about you, to request correction of inaccurate information, and to withdraw consent (subject to legal or contractual restrictions).
If you have a complaint about how we handle your personal information that we have not resolved to your satisfaction, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca or 1-800-282-1376.
Australian residents
Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the right to access the personal information we hold about you (Australian Privacy Principle 12), to request correction of inaccurate or incomplete personal information (Australian Privacy Principle 13), and to make a complaint about how we have handled your personal information.
If we cannot resolve your complaint to your satisfaction, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.
SMS marketing program
If you opt in to receive SMS messages from Bettr, you can opt out at any time by replying STOP to any message we send. You can request help by replying HELP. Message and data rates may apply. Message frequency varies by program. Bettr does not share SMS opt-in consent with any third party. No mobile information you provide to enroll in our SMS program is shared with third parties or affiliates for their marketing or promotional purposes.
Do Not Track signals
Some browsers transmit a "Do Not Track" (DNT) signal. There is no industry-standard interpretation of DNT signals at this time, and we do not alter our data collection or sharing practices specifically in response to a DNT signal. We do honor Global Privacy Control (GPC) signals where technically feasible — see Section 12 below.
Business transfers
If Bettr is involved in a merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or other business transaction, personal information we hold may be transferred or disclosed to a successor or potential successor entity in connection with that transaction, including during diligence. The successor will be bound by this policy or, if the successor adopts a new privacy notice, by reasonably equivalent obligations. We will notify you of any change in control by email or by posting a prominent notice on the site.
11. Children
The site is not directed to children under 18, and we do not knowingly collect personal information from anyone under 13 (United States), under 13 (Canada — varies by province), or under 18 for our service generally. If you believe a child has submitted personal information through the site, contact us at support@bettrsauna.co and we will take prompt steps to delete it.
12. Do Not Sell or Share My Personal Information (US)
We do not sell personal information for monetary consideration. Some uses of advertising and analytics tools (such as Meta Pixel, Google Analytics 4, and similar) may be considered "sharing" or "sale" of personal information for cross-context behavioral advertising under the California Consumer Privacy Act and similar US state laws.
To opt out of any such sharing for purposes of cross-context behavioral advertising, email support@bettrsauna.co with the subject line "Do Not Sell or Share," or use the cookie-banner controls if available. We honor Global Privacy Control (GPC) signals where technically feasible.
13. Changes to this policy
We update this Privacy Policy as our products, processors, and applicable laws change. The current version is identified by the "Last updated" date below. Material changes will be posted on this page and, where the change is significant and we have your email, communicated by email. Continuing to use the site after a change becomes effective is your acceptance of the updated policy.
