Terms of Service

These Terms of Service govern your use of the Bettr Sauna website at bettrsauna.co and your purchase of any product or service from us. By using the site or placing an order, you agree to these Terms.

The seller and operator is Salus Ventures LLC, a Wyoming limited liability company, with operations at 11–15 31st Drive, Astoria, NY 11106. You can reach us at support@bettrsauna.co or by phone at +1 (646) 787-1414. In these Terms, "we," "us," "our," and "Bettr" refer to the company. "You" refers to the person using the site or buying our products.

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract to use this site or place an order. We sell to individual residential customers in most international markets, including the contiguous United States, Canada, the United Kingdom, the European Union, Australia, New Zealand, the United Arab Emirates, and Saudi Arabia. See our Shipping Policy for the full delivery coverage. Orders for other countries may be reviewed individually and accepted on a case-by-case basis.

Submitting an order is an offer to buy. The order is not confirmed until we send a separate order confirmation email. We may decline or limit orders for any lawful reason, including suspected fraud, suspected reseller activity, freight forwarder shipping addresses, inventory constraints, or pricing errors.

Prices and product details are shown in good faith and may contain errors. If a product is listed at a clearly incorrect price (for example, a typo that posts a $10,000 sauna at $100), we may cancel the order before shipment and refund any payment in full. We will not be obligated to honor a price that the storefront displays in error.

Promotional pricing and bundled inclusions (for example, free accessories, free assembly add-ons, included shipping case) are valid only during their stated promotion window and only for orders placed during that window. We do not retroactively apply promotions to past orders.

Prices on the site display in your local currency via Shopify Payments where supported, or in US dollars otherwise. Sales tax, GST, HST, VAT, or equivalent is calculated at checkout based on your delivery address. Orders are shipped Delivered Duty Paid (DDP) where supported — duties and import fees are included in your checkout total, so you don't deal with surprise charges at the border. For destinations where DDP is not available, any unpaid duties or brokerage fees are quoted before you confirm the order.

We accept payment through Shopify Payments (Shopify Inc.) for credit and debit card transactions.

You authorize us (and our payment processor) to charge your selected payment method for the full amount of your order, including any applicable taxes and fees, at the time the order is placed.

We provide free curbside delivery on every order to most international destinations — see our Shipping Policy for the full country list and any quoted-only regions. Plan on 4-9 weeks from order to delivery. Title and risk of loss transfer to you at the time the freight carrier delivers the crate to your stated delivery address. After that point you are responsible for the unit, including for any subsequent damage or loss not caused by a defect covered by our Warranty. Visible freight damage discovered at delivery must be reported on the bill of lading at the time of signing — see our Shipping Policy for the inspection and claim procedure.

You may return an unused or used Bettr Sauna within 365 days of delivery, subject to the conditions in our Return Policy. The return policy includes a standard restocking fee, requires the original crate, and requires the customer to pay return freight. Pre-shipment cancellations are subject to a 5% cancellation fee. Refunds are issued to the original payment method within 7-10 business days after we receive and inspect the returned unit.

Payment disputes and chargebacks. You agree to first attempt to resolve any payment dispute through Bettr's return and warranty processes before initiating a chargeback with your card issuer. Initiating a chargeback for a product you have received without first contacting Bettr is a breach of these Terms. If a chargeback is filed and decided in your favor while you retain possession of the product, you authorize Bettr to recover the product at your expense, or, alternatively, to invoice you separately for the value of the retained product. Nothing in this paragraph waives your rights under applicable card-network rules or consumer protection law.

Each Bettr Sauna sold and delivered through this site carries a limited warranty: 2 years on the Harvia heater and control unit (manufacturer warranty administered by Bettr), and 3 years on the cabin and benches (Bettr structural warranty). Both periods are flat, non-transferable, and run from the date of delivery. Coverage scope, geographic eligibility, exclusions, and the claim process are described in full on our Warranty page. The Warranty page contains the controlling terms; this section is a summary only.

The Bettr Sauna name, the Bettr logo, the website design, product photography, copy, illustrations, video, and all related materials are owned by Salus Ventures LLC or our licensors. You may not reproduce, redistribute, modify, or commercially use any of those materials without our prior written permission. You may share product pages on personal social media in their unmodified form.

When using the site you agree not to:

• Place an order with the intent to resell our products without our written authorization
• Use the site to misrepresent your identity, payment information, or delivery address
• Attempt to access another customer's account or order data
• Interfere with the operation of the site, including by automated means (scraping, denial-of-service, vulnerability scanning) without our prior written authorization
• Submit false or misleading reviews
• Use the site in violation of any applicable law in the United States, Canada, or Australia

The site is provided on an "as available" basis. While we work to keep product specifications, copy, and pricing accurate, we do not warrant that the site will be free of errors, interruptions, or technical issues. Saunas are products that involve electrical systems, high temperatures, and physical assembly; we recommend consulting your physician before use if you have a medical condition that may be affected by heat exposure, and we recommend a licensed electrician for any electrical work the unit requires.

Express product warranties are limited to the warranty described in our Warranty page. To the extent permitted by your applicable law, all other express warranties not specifically described on the Warranty page are disclaimed. Implied warranties — including the implied warranty of merchantability and the implied warranty of fitness for a particular purpose — are limited in duration to the term of the applicable express warranty (2 years for the Harvia heater and control unit; 3 years for the cabin and benches), to the extent your state, province, or territory allows that limitation.

Nothing in this section excludes, restricts, or modifies any non-excludable consumer rights you may have under the Australian Consumer Law, the Canadian Sale of Goods Act, applicable provincial consumer protection statutes, or US state consumer protection law. The express warranty above is in addition to those rights, not in place of them.

To the extent permitted by applicable law, our total cumulative liability to you arising out of or relating to your purchase or use of any Bettr product, or your use of the site, will not exceed the greater of: (i) the aggregate amount you have paid Bettr for products in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred US dollars (US$100). Bettr will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of use, lost profits, lost savings, business interruption, or property damage, even if we have been advised of the possibility of such damages.

Some US states, Canadian provinces, and the Australian Consumer Law do not permit the exclusion or limitation of certain damages or warranties. Where that is the case, the above limitations apply to the greatest extent permitted by your applicable law and do not affect any rights you have that cannot be lawfully excluded.

You agree to indemnify and hold Bettr, its officers, employees, and contractors harmless against any third-party claim, damage, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of applicable law, or (c) the installation, modification, or use of a Bettr Sauna by you or anyone you permit to use it, where the loss is not caused by a defect for which we are responsible under our Warranty.

We are not responsible for delays or failures in performance caused by events outside our reasonable control, including natural disasters, severe weather, fire, flood, port closures, freight carrier strikes, government action, war, terrorism, epidemic or pandemic measures, supplier failures, or other force majeure events. We will make commercially reasonable efforts to communicate any material delay caused by these events and to resume performance as soon as practicable.

Governing law. These Terms are governed by the law of the State of Wyoming, USA, without regard to its conflict-of-law principles.

Informal resolution first. Before filing any arbitration or lawsuit, you agree to first contact us at support@bettrsauna.co with a written description of your claim. We will work in good faith to resolve the issue within 30 days. Many disputes can be resolved this way without further escalation.

Binding individual arbitration. If we cannot resolve a dispute informally, the dispute will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, except as modified here. The arbitration will be conducted by a single arbitrator. Hearings, if any, will be held by video conference, by telephone, or — at the customer's election — at a location in or near the customer's county of residence. Arbitration filing fees, arbitrator fees, and administrative fees are paid in accordance with the AAA Consumer Arbitration Rules; under those rules the customer's filing fee is capped, and Bettr is responsible for the balance of AAA's fees and the arbitrator's compensation. Each party is responsible for its own attorneys' fees unless an applicable statute or arbitrator's award provides otherwise.

Class-action waiver. All claims must be brought on an individual basis. You and Bettr waive any right to participate in a class action, class-wide arbitration, private attorney-general action, or representative proceeding. The arbitrator does not have authority to consolidate claims or to preside over any form of class or representative proceeding.

30-day opt-out from arbitration. You may opt out of the arbitration and class-action waiver above by sending written notice to support@bettrsauna.co with the subject line "Arbitration Opt-Out" within 30 days of your first purchase or first acceptance of these Terms (whichever is earlier). Your notice must include your full name, the email address used for any account or order, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms. If you opt out, any dispute will instead be resolved in the courts identified below.

Small claims carve-out. Either party may bring an individual claim in small claims court for any matter that qualifies for small claims jurisdiction in the customer's place of residence, regardless of the arbitration provision above.

Court forum for opt-outs and non-arbitrable claims. For any claim that is not subject to arbitration (including timely opt-outs, small claims matters, and claims for injunctive relief to protect intellectual property), the exclusive forum is the state and federal courts located in Sheridan County, Wyoming, USA. You and Bettr consent to personal jurisdiction in those courts.

Consumer rights preservation. If you reside in Canada or Australia, the choice of governing law above does not deprive you of any non-excludable consumer rights under the law of your country of residence, and you may bring any consumer-protection claim in the courts of your home jurisdiction where applicable law gives you that right. If you reside in California, Colorado, Connecticut, Utah, Virginia, or another US state with non-waivable consumer protection law, that law continues to apply to your claim regardless of this section.

We may update these Terms from time to time as our products, processes, or applicable laws change. The current version is identified by the "Last updated" date below. Material changes will be posted on this page and, where we have your email and the change is significant, communicated by email. Continuing to use the site or place orders after a change becomes effective is your acceptance of the updated Terms. If you do not agree with the updated Terms, stop using the site and contact us about any pending order.

We may suspend or terminate your access to the site or refuse to fill orders if you breach these Terms. Sections that by their nature should survive termination (Disclaimers, Limitation of Liability, Indemnification, Governing Law, Intellectual Property) survive.
